Terms of Reference:

  1. Introduction to the Organization

Institute of Social Development (ISD) is a non-governmental organization based in Kandy Sri Lanka, established in order to empower the marginalized and discriminated Plantation community. ISD was founded in 1991 by a group of intellectuals.  For the last two decades, ISD executed various programmes on Human Rights awareness and capacity building in order to empower the marginalized plantation community. At present, ISD is involved in sensitizing and advocating the plantation community in varied aspects such as Human Rights, Labor Rights, Housing and land rights and empowerment of Women. In the year 2011, the ISD broadened its programmes thus expanding its services to the most vulnerable in the Plantation sector.

 "Strengthen the marginalized plantation, rural communities and groups towards sustainable social changes based on democracy, equity, social justice, freedom and peace".

"To empower the marginalized plantation community to demand and defend fundamental human, labour, gender and other rights".

 2. Introduction to the Project

The project “Empower plantation women and Community to enjoy the rights as nation” works on empowering the plantation community who are excluded from local government development and to mainstream them to take part in local government activities.

The Project works on forming and strengthening the Rural Development Societies and Disaster Management Committee in the 30 estate locations to obtain the services of Divisional Secretariat, Pradeshiya Sabha and other government institutions while lobbying with the policy makers and political representatives to bring amendment to relevant legislations. Further, the project lobbies the policy makers on Housing and Land Rights, Environmental Rights, Women and Labour rights.

The Hill Country Tamil Community is excluded from mainstream development since the introduction of Local Government Act in 1939. The exclusion of the community continues even after the introduction of the PS Act in 1987 where the Section 33 of the Act prevents the elected members of the Pradeshiya Sabha (PS) to use the PS funds for the development of the plantation community. Hence, due to poverty, section of married and unmarried plantation working women and girls migrate to the Middle – East countries as domestic workers. Some end- up as internal domestic workers. The external migrant workers, return to the country with severe harassment and in some cases, even death. On the other hand, children of the migrant workers’ family, face severe problems, especially the girl children. The girl children become victim of sexual abuses. Some school going children become pregnant due to incest and abuse by the relatives and schoolteachers. The government brought in legislation to prohibit migrants who have female children below the age of five. The government appointed development officers to look into the issues of the migrant workers and their families. These officers do not reach out to the estate community like other Development Officers.

The Foreign Employment Bureau has capacity building programmes for the migrant workers. These programmes do not reach the plantation community. The ignorance of the country laws and culture, led the migrant workers to face numbers of problems. Further, the family members of the migrant are ignorant with regard to keeping records of the migrant member and their host country information. Similar to the extra domestic workers, the internal domestic workers too face number of violence.

Therefore the third major objective of this project expects Capacitated youth and women of HCT lobby for gender equality and fight against gender based violence, the project create the path to the government foreign employments’ staff to meet the estate community and solve the issues due to migrant.

3. Target Groups

The project locations include 30 estate divisions belonging to Panwila, Ambagamuwa, Nuwara Eliya Walapane, Ambanganga and Rattota Divisional Secretariats of Nuwara Eliya, Kandy, and Matale districts. The direct and indirect target group of the project include approximately 15,000 Tamil-speaking plantation families residing in the above 6 Divisional Secretariats.

  • The project area is identified as the most vulnerable areas in respect to poverty, health and education by EU, World Bank and Local NGOs namely the districts of Nuwara Eliya, Matale and Kandy. ISD will focus most vulnerable estate settlement which comes under above mentioned districts. Further these are the new areas where ISD didn’t implement any activities.
  • The focus area will be 10 estates in Matale, 6 estates in Kandy and 14 estates in Nuwara Eliya.
  • From each district in Nuwara Eliya, Matale and Kandy, totally 30 estates will be covered in central province. An estate will consist of approximately 100-150 families. The project will be covering approximately 15,000 families.
  • The project will establish new 30 RDS and DMC in 30 estates.

  • Total Men Beneficiaries  : 94,906
  • Total Youth Beneficiaries    : 55,727 ( Extracted from total beneficiaries)

4. Objective of the Project

The project has four major objectives to be accomplished within the project period
and the 2nd major objective is related to Migrant workers Descriptions are available below:

Objective 2:  Capacitated youth and women of Hill Country Tamil lobby for gender equality and fight against gender based violence.

Indicators: 

  • 15 potential women of 30 RDS contested for the local government elections during the project period
  • The no of violence cases indicated to the RDS is increased by at least 1%.
  • 5% increased of Plantation workers wage. (The outcome of the study increased the bargaining power of plantation trade unionist and increased plantation workers living wage covering 402 tea and rubber plantation estate workers)

Activities (Briefly)

  • Create awareness for potential + migrant workers
  • Identify the issues of the migrant workers families in relation to girl and boy children provide guidance and link them relevant ministries/child right authority to obtain the services and protection
  • Community level discussion/consultations for family members 
  • Conduct community based discussion for potential migrant workers and community members on host country laws/kafala / culture and precaution measures
  • Conduct a study on outward migration of women and youth in plantation sector

5. Reasons, Scope and the Objectives of the Risk Assessment Survey

The ISD wishes to study the existing issues related to the migrant in the 30 focused estates and level of government involvement and community. Prime purpose of this assignment is identify the migrant workers (Middle East & Local migrant) and the issues face by them in the work places related, labour and social security as well as workers’ rights. An assessment of the issues faced by family members specially focusing on children, girls and elders in 30 estates covering three districts.

 

Objectives of the Migrant Assessment:

  • To assess the incidences faced by migrant workers while working abroad and local.
  • To assess the knowledge and understanding on migrant workers rights, as well as to access, what can be done for preventing and reduce the migrant workers issues?
  • Assess the existing relationship and linkages with government institutions related to migrant issues.

5. Expected Results

The following are the key deliverables for the baseline process:

  • Develop a report with recommendation to migrate or prevent issues face by the migrant workers and their family members.
  • Share study design including process, methods and questionnaires/checklist with project team, collect feedback and finalize the study design.
  • Prepare and share pre-test questionnaires and other tools.
  • Debrief/discuss with project team about effectiveness of questionnaire, checklists and other tools used in pre-test, collect feedback and finalize them.
  • Orient, train and supervise the enumerators.
  • Carryout field work together with enumerators.
  • Ensure the quality of information collected from fields, cross check with the validity of information collected and verify/revise if needed.
  • Update progress of the study on weekly basis to Project Manager.
  • Analyze the data and prepare quality report.
  • Give a presentation of draft report to Practical action.
  • Submit the final report, data sheet and filled questionnaires to the project after incorporating the feedbacks and suggestions from ISD.

The report should be submitted in English language and should be of high enough quality to share with outside agencies, donors or interested third parties. It should provide substantive baseline against indicators as outlined in the project document.

Additional outputs include a Power Point presentation on key findings and a soft copy of all the relevant documents in a CD. 

7. Timeline/ Schedule

The period of this assignment is from 15th February 2019 to 31st March 2019 including the submission of final assessment report.

 7. Key qualifications of the Researcher

 The assignment will be contracted to consultants with

  • Experience in the area of civil society engagement, Environmental Protection, Governance, human rights and gender.
  • Substantial experience working with the plantation communities and their environmental impacts related issues.

The consultant should have:

Education

  • A university degree at the post-graduate level in social sciences or other relevant field of study

 

Work experience

  • Minimum 5 years of experience in developing, supporting, implementation and evaluation of migrant related projects/ programmes in local and international organizations
  • Solid understanding of governance and government structures as well as the culture within the context
  • Proven work experience in use of migrant works, participatory research and baseline methods for identifying contextual analysis
  • Competence in EIA techniques
  • Excellent analytical and report writing skills
  • Good people and communication skills
  • Demonstrated ability to assess complex situations in order to succinctly and clearly distil critical issues
  • Must be a self-starter and be able to work independently with excellent demonstrated teamwork, coordination and facilitation skills
  • Experience in leading multi-disciplinary teams to deliver quality products in high stress and short deadline situations
  • Fluency in computer (bringing his/her own laptop to the mission will be required)

Skills:

  • Strong leadership and planning skills
  • Excellent written and presentation skills in English
  • Strong communication skills in Sinhala would be an added advantage
  • Ability to work in the multi-cultural team environment and to deliver under pressure/meet deadlines
  • Ability to network with partners on various levels
